DMTN Daniel and Cha Seung Won's son Cha No Ah to Receive Jail Sentences for their Marijuana Cases

After being convicted of their illegal use of marijuana, Daniel and Cha No Ah has been sentenced to jail and given a fine worth thousands of won.

The court has issued a sentence against DMTN (formerly known as Dalmatian) member Daniel and Cha Seung Won's son Cha No Ah.

In previous hearing, the prosecutor demanded a 1-year jail sentence and a penalty worth 6,690,500 won (6,034 USD) for the DMTN member.

The final decision was issued today, October 17. The court stated, "Daniel acted as the intermediary in the selling of marijuana 12 times and sold marijuana 4 times." The singer denied any involvement in the sale and use of marijuana when the investigation began. However, after a hair strand test was conducted Daniel was found to be positive of substance use.

The court sentenced him to a year in jail and an increased penalty of 7,160,000 won.

In a previous court hearing, Daniel pleaded for leniency with his lawyer stating that the singer grew up in the United States and therefore had a more relaxed attitude towards the use of marijuana. And because ignorance is not an excuse to break the law, the court argued that "Even if he has a weak recognition that smoking is illegal, it is still a crime especially selling and acting as the intermediary to this illegal trade."

Due to good conduct, the court decided to maintain that Daniel would only be given minimum jail time. "Daniel has participated in the hearings and investigations seriously and diligently and he has also expressed that he will enlist in the military on his own accord and serve the country. Taking these factors into consideration, we have sentenced him to the minimum amount that we can give him based on the law."

With regard to Cha No Ah's case, the prosecutor previously demanded that he be sentenced to 10 months of jail for smoking pot 2-3 times. Because he was not involvement in the actual trade of marijuana, the final sentence given to him was lighter and the court's final decision was to give Cha No Ah a 6-month jail term and a 2 year suspension. This simply means that if he stays out of trouble for his 2-year probation period, the judges will most likely nullify his jail sentence.
